What happens if a Muslim dies in debt?

Pending review by our scholars

Short answer

The debts must be paid from what the person left, right after funeral costs and before any bequest or inheritance shares. The hadith warns that a believer's soul is held back by his debt until it is paid, so heirs should settle it quickly. If the estate cannot cover it, heirs are not bound to pay from their own money, but doing so is a great kindness.

Hanafi position

The estate is used in this order: funeral costs, then debts, then bequests up to a third, then the inheritance shares. Heirs owe the debts only up to the value of the estate. Zakat may not be used to pay a deceased person's debts, since zakat must be handed into the ownership of a living recipient; creditors may forgive the debt.

Other madhhabs
Shafi'i
Unpaid zakat, and other debts owed to Allah such as an obligatory hajj, are paid from the whole estate before inheritance, even if the person left no bequest for them.
Maliki
Zakat may be used to pay off the debts of a deceased Muslim who left nothing to cover them.
Hanbali
Unpaid zakat, and other debts owed to Allah such as an obligatory hajj, are paid from the whole estate before inheritance, even if the person left no bequest for them.

Explanation

The Quran repeats, in the ayat of inheritance, that shares are given "after any bequest which was made or debt" (4:12). Before any heir receives a share, every debt the person owed is paid in full from the estate. The inheritance calculator works on what remains.

Debt is serious. The Prophet ﷺ said a believer's soul is held back by his debt until it is paid, and that a martyr is forgiven everything except debt. At first he would not lead the funeral prayer of a man who died owing money until someone took on the debt. These warnings fall hardest on those who borrow carelessly; whoever borrows meaning to repay, Allah helps him repay.

What heirs should do:

  • List every debt: loans, credit cards, unpaid bills, money owed to friends, and any unpaid mahr owed to the wife.
  • Pay them from the estate before dividing it, and do it quickly.
  • If the estate is not enough, ask creditors to forgive the rest. Paying it from your own money is a kindness, not an obligation.
  • In the Hanafi school, unpaid zakat and fidya are paid from the estate only if the person left a bequest for them, and then from up to a third.

While you are alive, write your debts down (2:282), list them in your Islamic will, and pay them off as you can. See the dua for debt and the dua for the deceased. Ask a mufti when the estate is complex or includes interest-bearing debts.

Ask a mufti about your own case. This answer explains the general ruling. When the details of your situation matter, as they do here, ask a qualified mufti and give them the full facts. Where to ask a scholar.

And for you is half of what your wives leave if they have no child. But if they have a child, for you is one fourth of what they leave, after any bequest they [may have] made or debt. And for the wives is one fourth if you leave no child. But if you leave a child, then for them is an eighth of what you leave, after any bequest you [may have] made or debt. And if a man or woman leaves neither ascendants nor descendants but has a brother or a sister, then for each one of them is a sixth. But if they are more than two, they share a third, after any bequest which was made or debt, as long as there is no detriment [caused]. [This is] an ordinance from Allah, and Allah is Knowing and Forbearing.

Debts are paid before inheritance is divided.

O you who have believed, when you contract a debt for a specified term, write it down. And let a scribe write [it] between you in justice. Let no scribe refuse to write as Allah has taught him. So let him write and let the one who has the obligation dictate. And let him fear Allah, his Lord, and not leave anything out of it. But if the one who has the obligation is of limited understanding or weak or unable to dictate himself, then let his guardian dictate in justice. And bring to witness two witnesses from among your men. And if there are not two men [available], then a man and two women from those whom you accept as witnesses - so that if one of the women errs, then the other can remind her. And let not the witnesses refuse when they are called upon. And do not be [too] weary to write it, whether it is small or large, for its [specified] term. That is more just in the sight of Allah and stronger as evidence and more likely to prevent doubt between you, except when it is an immediate transaction which you conduct among yourselves. For [then] there is no blame upon you if you do not write it. And take witnesses when you conclude a contract. Let no scribe be harmed or any witness. For if you do so, indeed, it is [grave] disobedience in you. And fear Allah. And Allah teaches you. And Allah is Knowing of all things.

Recording debts protects the borrower and his heirs.
