Can a woman marry without a wali in Islam?

Pending review by our scholars

Short answer

In the Hanafi school, yes: an adult, sane woman can contract her own nikah. But if she marries a man who is not her equal (kufu) without her wali's consent, the relied-upon Hanafi fatwa is that the nikah does not take place. The Shafi'i, Maliki and Hanbali schools hold that a nikah without a wali is not valid at all.

Hanafi position

An adult woman's nikah done without her wali is valid if the man is her kufu (suitable match). If he is not her kufu and her wali did not agree before the contract, the fatwa position is that the nikah is not valid. Marrying without the wali is still against the sunnah and disliked.

Other madhhabs
Shafi'i
A woman cannot conclude her own nikah or anyone else's. A nikah without a wali is void. If the wali refuses a suitable match without reason, the judge (or his stand-in) marries her.
Maliki
The wali is a condition of validity. If he unjustly blocks a suitable match, the judge acts in his place.
Hanbali
A nikah without a wali is void, based on the hadith "no nikah without a wali".

Explanation

This is one of the best known differences between the schools. Abu Hanifa held that a sane adult woman has authority over her own marriage, just as she has over her own money. The Hanafis point to the hadith that a previously married woman has more right over herself than her wali, and to ayahs that speak of women marrying, such as 2:230 and 2:232. The other three schools take the hadith "there is no nikah without a wali" as making the wali a pillar of the contract.

The Hanafi permission comes with a real safeguard: kafa'ah (suitability). A man is her kufu when he is not clearly beneath her in the things her family and society count: religious practice, family background, the ability to pay the prompt mahr and support her, and a respectable means of living. Kafa'ah is the right of the woman and her wali. If she marries a non-kufu man without her wali's prior consent, later Hanafi scholars gave the fatwa that the nikah is not valid at all, to protect women from bad matches and families from harm. If she marries for far less than the usual mahr of her family, the wali may also object.

In practice, Hanafi scholars strongly advise that a woman never marries without her father or wali. It is the sunnah, it protects her, and it keeps the nikah valid in every school. If your wali refuses a good, practising man for reasons Islam does not accept, such as race or a wish for more wealth, speak to elders, an imam or a mufti before acting. The evidence

Quran, Surah Al-Baqara 2:232

And when you divorce women and they have fulfilled their term, do not prevent them from remarrying their [former] husbands if they agree among themselves on an acceptable basis. That is instructed to whoever of you believes in Allah and the Last Day. That is better for you and purer, and Allah knows and you know not.

Guardians are told not to block women from marrying, and the act of marrying is attributed to the women themselves.
