Short answer
In the Hanafi school, repeating the congregation in a local masjid that has a fixed imam and regular congregation is makruh, if it is done again in the original form, with adhan and iqamah at the imam's place. Latecomers pray individually, or as a group somewhere else, such as a side room. In masjids with no fixed congregation, such as at a motorway stop, a new group is fine.
A second congregation in a masjid with an appointed imam and regular congregation is makruh tahrimi when repeated in its first form. Abu Yusuf allowed it when the form is changed, such as praying away from the mihrab without a fresh adhan, and some Hanafi muftis act on this. In a masjid with no regular congregation, such as on a highway, repeating it is allowed.
Other madhhabs
- Shafi'i
- A second congregation is disliked in a masjid with a regular imam, unless he gives permission.
- Maliki
- A second congregation is disliked in a masjid with a regular imam.
- Hanbali
- A second congregation in the same masjid is allowed without dislike.
Explanation
The congregation in a local masjid is meant to be one gathering. Hanafi scholars disliked repeating it because it splits the people, and if everyone knew a second group would form, many would stop coming on time for the first. For this reason, in a neighbourhood masjid with an appointed imam and set times, a second congregation in the same form is makruh.
Abu Yusuf allowed a later group if they changed the form, for example by not calling a new adhan and standing away from the imam's place. Many Hanafi muftis follow this in practice, while others still advise latecomers to pray individually to protect the first congregation.
- Missed the congregation: pray individually in the masjid, or form a group in a side room or another area that is not the main prayer hall.
- Masjids on travel routes, at airports, malls or service stations, with no fixed congregation: groups may form one after another.
- Workplace prayer rooms are usually not masjids, so the rule does not apply there.
The other schools cite a hadith in which the Prophet ﷺ asked who would "give charity" to a latecomer by praying with him. Hanafi scholars say this was one person joining as a voluntary prayer, not an organised second congregation. See also is praying in congregation obligatory and joining the prayer late.
The evidence
Sunan Abi Dawud 574
Grading to be checked... ألا رجل يتصدق على هذا فيصلي معه ...
"Is there no man who will give charity to this one by praying with him?"
The hadith the other schools use; Hanafis read it as one person joining as nafl.
Where the ruling is recorded
- al-Durr al-Mukhtar with Radd al-Muhtar, Kitab al-Salah, chapter on the imamate. Repeating the congregation with adhan and iqamah in a neighbourhood masjid is disliked; not in a roadside masjid; Abu Yusuf allowed it with a changed form.
- al-Mughni (Ibn Qudama), Chapter on congregational prayer. The Hanbali school allows a second congregation in the same masjid.
