Do non-Muslim neighbours have rights in Islam?

Checked by our team

Short answer

Yes. A neighbour has rights whatever their religion. You must not harm them, and you should be kind, share food, help them and visit when they are ill. A Companion made sure his Jewish neighbour was given a share of meat, and the Prophet ﷺ said Jibril kept urging him about neighbours.

Hanafi position

Harming any neighbour is haram, and good treatment of neighbours, Muslim or not, is a strong sunnah. Giving gifts and charity, including qurbani meat and voluntary sadaqah, to non-Muslim neighbours is permitted.

The four schools agree on this.

Explanation

The Quran commands good treatment of 'the near neighbour and the neighbour farther away'. Many scholars explained that a neighbour may be a relative, a Muslim, or a non-Muslim, and each has rights. Allah also says He does not forbid you from being kind and just to those who do not fight you over religion.

The Prophet ﷺ said Jibril kept urging him to treat the neighbour well until he thought the neighbour would be made an heir. He swore three times that a person does not truly believe if his neighbour is not safe from his harm. When Abdullah ibn Amr had a sheep slaughtered, he kept asking his household, 'Did you give some to our Jewish neighbour?', and then quoted this hadith.

What this looks like:

  • no loud noise late at night, no blocked driveways, no rubbish or smoke drifting into their garden;
  • sharing food at Eid and in Ramadan, and greeting them warmly;
  • helping with shopping or snow, watching their house when they travel;
  • visiting when they are ill (see visiting a sick non-Muslim);
  • offering condolences when someone in their family dies.

Kindness to a neighbour is also the best dawah many people will ever see. You do not have to join in religious rites of their festivals, but you can be generous and friendly all year. The four schools agree on this. More in rights of neighbours and hadith about neighbours.

The evidence

Quran, Surah An-Nisaa 4:36

Worship Allah and associate nothing with Him, and to parents do good, and to relatives, orphans, the needy, the near neighbor, the neighbor farther away, the companion at your side, the traveler, and those whom your right hands possess. Indeed, Allah does not like those who are self-deluding and boastful.

Allah commands good treatment of every neighbour.

Quran, Surah Al-Mumtahana 60:8

Allah does not forbid you from those who do not fight you because of religion and do not expel you from your homes - from being righteous toward them and acting justly toward them. Indeed, Allah loves those who act justly.

Kindness to peaceful non-Muslims is allowed and loved by Allah.
