Questions Marriage and family

Is a court or civil marriage valid in Islam?

Checked by our team

Short answer

In the Hanafi school, a civil or court marriage between a Muslim man and a Muslim woman counts as a nikah if both clearly accepted each other in front of two adult Muslim witnesses, two men or one man and two women. If those were missing, it is not a nikah and you need to do one. The other three schools also require the wali.

Hanafi position

A nikah does not need an imam or Arabic words. If a civil ceremony contained a clear offer and acceptance from both in one sitting, heard by two Muslim witnesses, it is a valid nikah, with mahr al-mithl due if no mahr was named. If there were no Muslim witnesses or no real offer and acceptance, it is not a nikah. An adult woman's own acceptance is enough without her wali, but if the husband is not a suitable match (kufu) and her wali did not agree, the relied-upon fatwa is that the nikah is not valid.

Other madhhabs
Shafi'i
A nikah is void unless the bride's wali contracts it before two just Muslim men, so a civil ceremony alone is not a nikah.
Maliki
The wali is a condition of validity, so a civil ceremony without him is not a valid nikah.
Hanbali
The wali and two Muslim male witnesses are conditions, so a civil ceremony alone is usually not a valid nikah.

Explanation

Many Muslims marry at a registry office, a court or a city hall, either because the law requires it or before a family nikah. The question is whether that ceremony is also a nikah in the sharia.

The Hanafi test.

  • Offer and acceptance. Both clearly agree to marry each other, in any language, in one sitting. A registrar's question and each person's "I do" can serve.
  • Two witnesses. Sane adult Muslims, two men or one man and two women, who hear both sides together. Registrars and friends who are not Muslim do not count when the bride is Muslim.
  • Lawful partners and no time limit.
  • Suitability. An adult woman does not need her wali present, but if the husband is not a suitable match (kufu) for her and her wali has not agreed, the relied-upon Hanafi fatwa is that the nikah is not valid. See marrying without a wali.
  • Mahr. If none was named, the nikah stands and she is owed the mahr of a woman like her (mahr al-mithl).

A Christian or Jewish bride. Abu Hanifa and Abu Yusuf accepted two Christian or Jewish witnesses when a Muslim man marries a Christian or Jewish woman, while Imam Muhammad required Muslim witnesses. Scholars still advise Muslim witnesses so the marriage is sound in every view. See marrying a Christian or Jewish woman.

What to do. Many civil ceremonies have no Muslim witnesses, and three schools require a wali, so the safest course is to hold a proper nikah as well, on the same day or straight after. If you have been living together after only a civil marriage, ask a mufti whether it counted and do a nikah now. See unregistered nikah and witnesses for nikah.

The evidence

Quran, Surah An-Nisaa 4:24

And [also prohibited to you are all] married women except those your right hands possess. [This is] the decree of Allah upon you. And lawful to you are [all others] beyond these, [provided] that you seek them [in marriage] with [gifts from] your property, desiring chastity, not unlawful sexual intercourse. So for whatever you enjoy [of marriage] from them, give them their due compensation as an obligation. And there is no blame upon you for what you mutually agree to beyond the obligation. Indeed, Allah is ever Knowing and Wise.

Marriage is made by a contract with mahr, whatever the setting.

Quran, Surah An-Nisaa 4:21

And how could you take it while you have gone in unto each other and they have taken from you a solemn covenant?

Nikah is a solemn covenant with its own conditions.
