Questions Marriage and family

What are valid reasons for divorce in Islam?

Checked by our team

Short answer

A husband's talaq takes effect even without a stated reason, but divorce without need is disliked. A wife can seek khula when she cannot live with him within Allah's limits, and a Muslim judge or council can dissolve a marriage for harm, non-maintenance, desertion, a missing husband, impotence or serious illness. Every case needs a mufti.

Hanafi position

Talaq without need is disliked (makruh), and it is permitted for real need, such as lasting discord or a spouse's serious wrongdoing. For the wife, later Hanafi scholars, notably in al-Hila al-Najiza, adopted Maliki rulings so that a Muslim judge or council can dissolve the marriage (faskh) for failure to maintain, a missing or long absent husband, impotence, insanity and similar serious harm.

Other madhhabs
Maliki
Gives the widest grounds for dissolution by a judge, including any real harm (darar), failure to maintain and long absence.
Shafi'i
A judge may dissolve the marriage for inability to maintain and for certain serious defects. Discord is handled mainly through the two arbitrators of 4:35.
Hanbali
Allows dissolution for failure to maintain, serious defects and long absence, and arbitrators may separate a couple in lasting discord.

Explanation

Islam treats marriage as a solemn covenant, but it does not trap anyone in a marriage that has failed. The Quran first asks for patience and repair, and if needed an arbitrator from each family (4:35). Only when that fails is separation the answer, done with good treatment (2:229).

For the husband. Talaq is in his hands and takes effect even if he gives no reason. That does not make it right to divorce on a whim. Valid reasons include lasting conflict that arbitration could not fix, a wife's serious wrongdoing or abandonment of the marriage, or the fact that the two cannot keep Allah's limits together. Keeping a wife only to hurt her, or divorcing to harm her, is forbidden (2:231).

For the wife. The Prophet ﷺ warned that a woman who asks for divorce without a real reason will not smell Paradise. But real reasons are accepted:

  • She cannot bear living with him even though he is not at fault, as with the wife of Thabit ibn Qays. This is khula.
  • He harms her physically or emotionally.
  • He does not provide for her though able, or cannot provide.
  • He has disappeared, or left her for years.
  • Impotence, insanity or a serious illness that makes married life impossible.
  • He leaves Islam or forces her into sin.

In these cases, if he will not give talaq or agree to khula, a Muslim judge, or in the West a sharia council or Islamic tribunal, can examine the facts and dissolve the marriage. A civil divorce alone may not be enough. Because every case turns on its facts, speak to a mufti. See the divorce process.

Ask a mufti about your own case. This answer explains the general ruling. When the details of your situation matter, as they do here, ask a qualified mufti and give them the full facts. Where to ask a scholar.

The evidence

Quran, Surah An-Nisaa 4:35

And if you fear dissension between the two, send an arbitrator from his people and an arbitrator from her people. If they both desire reconciliation, Allah will cause it between them. Indeed, Allah is ever Knowing and Acquainted [with all things].

Reconciliation through family arbitrators comes before divorce.

Quran, Surah Al-Baqara 2:231

And when you divorce women and they have [nearly] fulfilled their term, either retain them according to acceptable terms or release them according to acceptable terms, and do not keep them, intending harm, to transgress [against them]. And whoever does that has certainly wronged himself. And do not take the verses of Allah in jest. And remember the favor of Allah upon you and what has been revealed to you of the Book and wisdom by which He instructs you. And fear Allah and know that Allah is Knowing of all things.

Holding on to a wife only to harm her is forbidden.
