Questions Zakat and charity

Do husband and wife pay zakat together?

Checked by our team

Short answer

No. In Islam each spouse owns their own wealth, so each checks their own nisab and pays their own zakat. You do not add a wife's gold to her husband's savings to reach the nisab. A husband may pay his wife's zakat for her from his money if she agrees, but he does not have to.

Hanafi position

Zakat is due on each owner separately. A wife's wealth is not combined with her husband's to reach the nisab, and he is not obliged to pay her zakat. Wealth held jointly is divided by each person's share.

Shafi'i
When two people's zakatable wealth is mixed in a genuine partnership (khultah) under set conditions, it may be zakated as one holding; separate savings of a couple are still zakated separately.

Explanation

Marriage does not merge property in Islam. The wife's mahr, her earnings, her gifts and her jewellery are hers, and the husband's wealth is his. Zakat follows ownership, so each spouse looks only at what they own. A wife whose own zakatable wealth is below the nisab owes no zakat, even if her husband is wealthy.

Joint accounts are split by who owns the money. If the account holds the husband's salary and the wife simply has access, it is his. If both pay in and the money is shared, each pays on their own share. Agree on who owns what, so that each of you can work out your zakat.

A common case: the wife has gold above the nisab but no income. Her zakat is still due. She can pay from her own money, sell a small part of the gold, or ask her husband to pay it for her. He is not obliged to, but if he does with her permission it counts, and it is a kindness; see paying zakat for someone else.

Each spouse also has their own zakat date, from when they first owned the nisab. To check whether a mix of cash and gold reaches the nisab, see gold or silver nisab. A wife cannot give her zakat to her husband in the Hanafi fatwa position; see can a wife give zakat to her husband.

The evidence

Quran, Surah An-Nisaa 4:32

And do not wish for that by which Allah has made some of you exceed others. For men is a share of what they have earned, and for women is a share of what they have earned. And ask Allah of his bounty. Indeed Allah is ever, of all things, Knowing.

Each spouse owns what they earn.

Where the ruling is recorded

  • al-Hidaya, Kitab al-Zakat, opening section on who must pay. Zakat depends on full ownership of the nisab by the person himself.
  • Minhaj al-Talibin, Kitab al-Zakat, section on mixed holdings (khultah). The Shafi'i rule on partnership holdings.
