Questions Marriage and family

What words make a talaq valid?

Checked by our team

Short answer

Clear words of divorce, such as "I divorce you" or "you are divorced", in any language, take effect even without intention. Indirect words, such as "go to your parents" or "you are free", count only if he meant divorce. No witnesses, imam or set formula are needed.

Hanafi position

Talaq takes effect with explicit words (sarih) used only for divorce, without needing intention, and these give a revocable talaq. Indirect words (kinayah) that can mean divorce or something else take effect only with intention or clear context, and give a ba'in talaq. Witnesses are not a condition of talaq.

Shafi'i
The words firaq (separation) and sarah (release) are also explicit. Indirect words with intention give a revocable talaq, like explicit words.

Explanation

Talaq is a few words, which is why it must be handled with care. There is no dua or set formula to say before it. What the sunnah asks before divorce is to try to reconcile, to pray istikharah, to wait for a clean period without intimacy, and then to say one talaq only. See the divorce process.

Explicit words (sarih).

  • "I divorce you", "I have given you talaq", "you are divorced", in English, Arabic, Urdu or any language.
  • These take effect whatever he intended, even as a joke.
  • A clearly written message addressed to her counts like speech. See divorce by text.
  • A number counts: "I divorce you three times" gives three in the Hanafi school. See three talaq at once.

Indirect words (kinayah). Phrases like "go back to your family", "you are free", "I do not want you" or "you are no longer my wife" can mean divorce or something else. They count only if he meant divorce. The Prophet ﷺ himself used "go back to your family" to end a marriage. In some situations, such as when she has asked for a divorce, the context alone can make some of these words count, so a mufti will ask exactly what was said and when.

What is not talaq: "I will divorce you" or other talk about the future, a threat, a thought, or a decision kept in the heart. But telling someone "I have divorced her" is taken as an admission, and a judge holds him to it even if he says he was lying. If words have been said and you are unsure, see when talaq is not valid and ask a mufti.

Ask a mufti about your own case. This answer explains the general ruling. When the details of your situation matter, as they do here, ask a qualified mufti and give them the full facts. Where to ask a scholar.

The evidence

Quran, Surah Al-Baqara 2:227

And if they decide on divorce - then indeed, Allah is Hearing and Knowing.

Divorce is a decision Allah hears, so words of talaq are serious.

Quran, Surah Al-Baqara 2:229

Divorce is twice. Then, either keep [her] in an acceptable manner or release [her] with good treatment. And it is not lawful for you to take anything of what you have given them unless both fear that they will not be able to keep [within] the limits of Allah. But if you fear that they will not keep [within] the limits of Allah, then there is no blame upon either of them concerning that by which she ransoms herself. These are the limits of Allah, so do not transgress them. And whoever transgresses the limits of Allah - it is those who are the wrongdoers.

Even the words of divorce should be done with dignity.
